Judge Sotomayor Sees "Disturbing Trend" of Courts Favoring Officers in Use-of-Force Rulings
Supreme Court Justice Sonia Sotomayor wrote Monday that the court is developing a “disturbing trend” of siding with police officers accused of excessive force at the expense of their alleged victims, a notion disputed by two of her colleagues.
Sotomayor was arguing that the court should have accepted the case of Richardo Salazar-Limon, who was shot in the back by Houston police officer Chris Thompson in 2010. A federal district judge dismissed Salazar-Limon’s suit before trial, and the U.S. Court of Appeals for the 5th Circuit upheld that decision, the Washington Post reports.
What happened in the incident that left Salazar-Limon crippled is disputed, Sotomayor wrote in her dissent, and a decision on which man is telling the truth should be made by “a jury sitting as finder of fact, not a judge reviewing a paper record.”
What made Sotomayor’s dissent unusual was the criticism of the court’s past decisions.
Her colleagues’ failure to accept the case “continues a disturbing trend regarding the use of this court’s resources,” Sotomayor wrote in an opinion joined by Justice Ruth Bader Ginsburg.

VIDEO: Cleveland Paper Posts Garrity Videos of Officers Involved in Tamir Rice Shooting
Two-and-a-half years after Tamir Rice, 12, was shot and killed by a Cleveland police officer who thought the boy's replica pistol was real, cleveland.com has obtained the videos - never before seen publicly -- of investigative interviews with the officers involved, Timothy Loehmann and Frank Garmback.
The interviews, conducted within days of the Nov. 22, 2014 shooting outside Cudell Recreation Center, include details not previously reported of the events and offer new insight into the mindsets of the officers.
In agreeing to be interviewed on camera by homicide detectives and internal affairs officers, Garmback and Loehmann invoked their so-called Garrity rights, which protect public employees from incriminating themselves in statements to their employer.
Garmback wept several times during his interview - recalling his realization that Rice was a boy, the way Rice looked as he lost consciousness and how long it took rescuers to arrive.

Three Arrested in Beating of CA Officers
Three men were arrested following an attack on Davis (CA) police officers who encountered a group of people blocking traffic on a busy roadway during Saturday’s Picnic Day at the University of California at Davis.
The incident occurred abut 3:30 p.m. Saturday, when three Davis police officers traveling on Russell Boulevard in an unmarked police vehicle encountered a large group of people in the roadway, blocking traffic, according to a Police Department news release.
A hostile group quickly surrounded the vehicle. As the officers got out of the car and began to identify themselves as police, two officers were attacked by several people and beaten on the ground. Police reported that the officers were kicked and punched in the head, and one officer was struck on the side of the head with a bottle.
The officers fought back and called for help. Two of the officers were taken to the emergency room for treatment. One suffered injuries to his eye and face, and the other was treated for a bleeding head wound caused by a bottle, the news release said.
Arrested were Alexander Reide Craver, 22, and Elijah James Williams, 19, both of West Sacramento, and Antwoine Rashadek Perry, 21, of Elk Grove. All were booked into Yolo County jail, the Sacramento Bee reports.

VIDEO: Shots Fired into TX Deputy's Home
Shots were fired into the Diana, TX, home of an Upshur County Sheriff's deputy and into her take-home patrol vehicle Saturday night. Some of the rounds fired into the home impacted near the deputy's child.
According to a sheriff's office release, one round entered the home and lodged in the clothing that was worn by the deputy’s child. The child was not injured. Another round struck the chair that the child was seated in as he played video games near the front window.
The sheriff's office said, "Due to the amount of damage done to the patrol car, investigators are looking into the likelihood of retaliation motive on the part of persons having interaction with the Upshur County Sheriff’s Office or one of its deputies."
"It saddens me that this has occurred in this county and has targeted your law enforcement agency and our front line deputies," Sheriff Larry Webb said. "I know that the citizens will stand with us so that the persons who did this are brought to justice. This cannot and will not be tolerated.
In addition to the impact on the targeted deputy and family members, this kind of act requires agency resources that could better be spent on the protection of our country’s residents and taxpayers. In short, we are all affected by this act."
Witnesses observed that the shooters were in a brown or tan passenger car. The car left west on FM Road 3245 going toward Highway 259.
