Proposed California Legislation Would Limit Who Can Be Charged with Felony Murder
The California legislature has sent to the governor proposed legislation that would significantly limit who can be charged under the felony murder rule—under which defendants can be convicted of first-degree murder if a victim dies during the commission of a felony, "even if the defendant did not intend to kill or did not know a homicide occurred," according to the Los Angeles Times.
The legislation— introduced by Senator Nancy Skinner (D-Berkeley)—would restrict the criminal charge to those who committed or intended to commit a killing. It also would allow some inmates incarcerated for felony murder to petition the court for a reduced sentence.
Senate Bill 1437 would "require a principal in a crime to act with malice aforethought to be convicted of murder except when the person was a participant in the perpetration or attempted perpetration of a specified felony in which a death occurred and the person was the actual killer, was not the actual killer but, with the intent to kill, aided, abetted, counseled, commanded, induced, solicited, requested, or assisted the actual killer in the commission of murder in the first degree, or the person was a major participant in the underlying felony and acted with reckless indifference to human life," according to California Legislature documents.
The legislation moved out of the Senate with a 27-9. It moved out of the Assembly with a 41-35 vote.
Language in the bill can be changed for up to 30 days.

Good Samaritan Pulls Sheriff’s Deputy Out Of Burning Squad Car
An unknown man rescued a Cook County Sheriff's Deputy from her burning patrol vehicle early Thursday. The officer had been trapped in her squad car following a collision with another vehicle, according to the Chicago Tribune.
The officer was on her way to a domestic-related call at the time, but it's unclear how the accident occurred or why the vehicle caught fire, the report said.
A man then stopped and pulled the officer from the burning vehicle, but he quickly left the scene and police were unable to get his name or any other information about him.
The officer was taken to a nearby hospital and treated for her injuries, which are not life-threatening.

Texts Show North Carolina Chief Told Officers to 'Not Engage' Protesters
Chief Chris Blue of the Chapel Hill (NC) Police Department instructed his officers to stand aside last week as protesters pulled down a controversial Confederate monument on the University of North Carolina campus, according to Fox News.
Demonstrators tore down the Confederate monument known as 'Silent Sam' last week, as officers from Chapel Hill PD and the UNC Police Department stood aside.
WRAL-TV obtained bout 400 pages of emails and texts to and from Blue on the day of the protest and the day afterward, and the messages showed Blue instructing the officers to give the protesters "lots of space" and "stay way out."
The texts also revealed that Blue was particularly concerned about the potential arrival of counter protesters who could enflame the situation.
"Need to make sure our plainclothes guys are really looking out for counter protesters to arrive," Blue texts at 7:35 p.m. "This thing is all over tv and internet. The longer they take with the statue the more time Folks have to arrive."
No one was injured during the protest, and three people were charged with misdemeanor rioting and misdemeanor defacing a public monument in connection with the statue's toppling.

Oregon Officers Save Pet Fish from Tank Filled with Garbage, Cigarette Butts
Police officers with the Gresham (OR) Police Department have a new officemate—a fished named Rocky.
"Sometimes we run across people that unfortunately can no longer care for their pet. When officers located this fish (now named Rocky), its tank was half full of garbage and cigarette butts," the department said on its Facebook page. "It's amazing that Rocky was still alive."
Officer Tatro took Rocky into CB's Tropical Aquarium to get help.
"The kind owner not only assisted in keeping Rocky alive, he also insisted on donating Rocky's supplies," the Facebook post said.
"We thought everyone should get a chance to see and meet Rocky, so he has found a new home at our Rockwood Office greeting citizens that come in. Feel free to stop by and say hi."
Community members posted supportive comments on the good news.
"Great job everyone. Thank you Gresham officers for your service," on person said.
When one individual inquired about when Rocky will get his own badge, the department commented back, "Great idea! Gonna have to work on that. Lol"

DA: Police Not at Fault for Death of Pennsylvania Man During Search
Berks County District Attorney John Adams has concluded that the death of 51-year-old Gregory Longenecker as he fled police into a thicket of tall grass was his own fault, not the fault of the police who were chasing him.
Following a nearly two-month-long investigation into the incident, Adams concluded that the man had crawled under the bulldozer that ended up crushing him.
Bernville police Chief Brian Thumm and a Pennsylvania Game Commission employee had discovered Longenecker—and his friend David Light—in the vicinity of a marijuana-growing operation enclosed by chicken wire in a hidden clearing, according to the Reading Eagle.
Light surrendered, but Longenecker fled.
"We can only guess he crawled under the back of the bulldozer to avoid detection," Adams said.
Toxicology tests found Longenecker had methadone, methamphetamine and cannabis in his system at the time of his death. The levels of methadone and methamphetamine were almost toxic, Adams said.

Connecticut Police Detonate "Pressure Cooker" Device Found Near Elementary School
Officers with the Meriden (CT) Police Department were called to investigate a reported suspicious package not far from Israel Putnam Elementary School in Meriden Thursday morning. They discovered what they called a "pressure cooker type device" and initiated a "shelter-in-place" until the bomb squad could detonate the device.
Police said they responded just before 0800 hours and the State Police Bomb Squad conducted a controlled detonation on the package just before 1030 hours.
The shelter in place order—which was issued not only for the school but for the surrounding neighborhood—was lifted around 1100 hours.
Meriden Mayor Kevin Scarpati commended the school resource officer, who was the first at the scene and was the individual who initiated the school's safety protocols, according to WVIT-TV.

Customs Agents Use New Facial Recognition Technology to Nab Impostor at Airport
It was just the third day of operation for a new facial comparison biometric system now being used by U.S. Customs and Border Protection (CBP) at Washington Dulles International Airport when a man presenting a French passport was discovered to in fact be from Republic of Congo.
A 26-year-old man traveling from Sao Paulo, Brazil presented a French passport to the CBP officer conducting primary inspections, according to Homeland Security Today. The agency's new facial comparison biometric technology confirmed the man was not a match to the passport he presented.
Upon further inspection, his authentic identification was located in his shoe.
"Facial recognition technology is an important step forward for CBP in protecting the United States from all types of threats," said Casey Durst, CBP’s Director of the Baltimore Field Office. "Terrorists and criminals continually look for creative methods to enter the U.S. including using stolen genuine documents. The new facial recognition technology virtually eliminates the ability for someone to use a genuine document that was issued to someone else."
The impostor intercepted at Washington Dulles International Airport was the first impostor detected using the new technology.

San Francisco POA Opposes Proposed "Safe Injection Sites" for Drug Users
San Francisco Mayor London Breed and other city officials who want to open the nation’s first facility where drug users would be able to shoot up in an enclosed and supervised environment.
Earlier this week, proponents of a proposal to open so-called "safe injection sites" gave a demonstration of what such a facility could look and feel like.
"San Francisco public health officials hope that by providing access to meal services, showers, dental care, mental health and medical referrals, they can help slowly guide people away from their addictions and street life and toward more stable environments," said a report by the San Francisco Chronicle.
But not everyone in San Francisco is in support of the idea.
Rick Andreotti, vice president of the San Francisco Police Officer's Association, told KRON News that while he's happy the city is concerned for people's well-being, he doesn't think this is the right way to stop the drug epidemic.
"Is this the proper solution? We don't believe so," Andreotti said. "We are concerned that an increase, or influx of addicts in San Francisco, will cause an increase in petty crimes, quality of life issues and we all know that's a major issue in San Francisco."
Opening day for the prototype site came less than 24 hours after the state Assembly signed off on a final round of amendments to AB186, a bill that would allow San Francisco to create a pilot program for safe injection sites through January 2022, according to the Chronicle.
The bill is now awaiting Governor Jerry Brown’s signature.

Texas Officer Who Pointed Gun at Kids Cleared of Wrongdoing
An investigation in to an incident in July in which an officer with the El Paso (TX) Police Department pointed his service pistol at a group of kids who were taunting him during an arrest has found that the officer did not wrongfully draw his gun.
In the July 5 incident Officer Jose Rios was attempting to effect the arrest of two juveniles when he was surrounded by a number of other juveniles who closed in on him as they shouted taunts. The incident was captured on cell phone video, which quickly went viral on social media.
Chief Greg Allen said at a news conference Thursday, "The fact that he was involved in an incident that drew a lot of attention is no reason, in my opinion, and I know I'm right on that, to take that person out of those communities simply because there was an outrage at one point," according to the El Paso Times.
Elizabeth Flores, whose sons Julian and Jacob Saucedo were arrested during the incident, said she has hired an attorney and is in the process of filing a civil lawsuit against Rios.
Rios was placed on desk duty after the incident but has since returned to regular duty in the same area.

Telling the Stories of American Police Officers' Courage and Compassion
Earlier this week it was reported that two officers with the Fort Worth (TX) Police Department rescued a suicidal woman who was standing precariously atop the safety barrier on a very high highway bridge — an event that was captured on dramatic body-worn and dash-camera footage.
Officers Trae Cierzan and Justin Henry slowly approached the woman as she said, "Everybody wants me dead."
"Nobody wants that," one officer replied. "Please get down," he said.
"You don't want to do this," the other officer added. "You want to come talk to us," he pleaded.
Then — in a flash — the two officers closed the remaining distance, grabbed the woman, and brought her to safety.
In less than one second, those two cops ensured that the distraught woman would awake the next day, rather than the alternative.
"We're going to get you some help, okay?" one of the officers said as they put the woman in handcuffs.
Raw, pure human compassion.
I was delighted not only at the outcome of the incident, but that the newspapers and television stations across the Lone Star State — it was reported by the Star-Telegram, the Dallas Morning News, FOX4News, and a host of others — gave the two officers their due praise.
It is praise these guys rightfully earned, but probably didn't want or need.
They're probably like most cops, who after an extraordinary event humbly say, "I was just doing my job."
Perhaps that's true — doing the extraordinary is just an ordinary day's work for police officers — but the general public doesn't know that.
In today's climate, it's a good idea to allow the limelight shining on some positive news coverage to linger, and to counteract how often — literally, on a daily basis — police officers perform acts of heroism and valor that go entirely unnoticed by everyone except the individuals immediately affected.
Here's why police agencies should take a page from Fort Worth's playbook and highlight police officers' stories of service to the community that are typically unheralded.
Not Crisis Communications
For the longest time, law enforcement agencies have been their own worst enemy in the area of public relations — and by that, I do not mean relating with the public.
I'm talking about PR.
Police communication with the media has historically been almost exclusively in response to a critical incident — and what's worse, in many cases, the statements made to the press were a jumble of stiffly spoken sentences revelatory of nothing more than basic facts.
That, or the chief and the PIO fell back on the dreaded default: "No comment."
Not good.
Back when television screens were black and white and the remote control "clicker" was your nine-year-old son or daughter, I was a public relations guy.
Okay, it wasn't quite that long ago, but it sure feels that way.
Anyway, I worked in a big ornate office with more than a hundred other expert spin doctors, and the absolute last thing in the world any of us wanted to do was "crisis communications" — which is precisely what most police press conferences are all about.
Something bad happens. A gaggle of satellite trucks suddenly appears on the street where the bad thing happened. And the chief and the PIO are peppered with questions from a hostile crowd of reporters.
Not fun — and not easy to control.
Importantly, also not what a PR guy would call "strategic communications."
The Five Cs
The mainstream news media generally cover events that contain one or more of the following elements: conflict, controversy, change, comedy, and cash (when the dollar amount is big enough). I have a whole PowerPoint presentation on this thesis called The Five Cs, but that's another matter for another time.
Every so often, however, the press will latch onto an incident that highlights humanity's courage and / or compassion — two more Cs that have subsequently been added to the abovementioned presentation.
However, reporters are highly unlikely to file a FOIA request to find stories of daring gallantry by law enforcement officers.
You have to tell them about it.
They'll look into it and decide if the story makes the cut for a two-minute segment at five o'clock or a couple column inches in the Metro section.
So when Fort Worth PD proactively invited their local media to a press conference to show the dash- and body-worn camera footage of the bridge incident — and allow their officers to answer questions and talk about their experiences on that day — I was very pleased indeed.
Telling Police Stories
With the advent of social media, police agencies really don't even need the mainstream media to show up at the PD for the presentation — it's a good idea to try, but if you get a room full of crickets, go directly to the people.
Camera footage — and we know that we have an abundance of body-worn and dash-camera video — can simply be posted on social media with a written explanation of the event.
Plenty of police agencies are now becoming expert at using social media.
Sidebar: Just about every department today has a Facebook page. However, not every department uses the medium to its fullest capacity. If you think you could use some help, just look around, find a PD that seems to have a good, vibrant social media presence, and reach out to them for tips on how they do things. It's really not rocket surgery, but there are some best practices out there.
Plenty of pro-police citizens follow your department on Facebook and Twitter — and these are precisely the people with whom you should be directly communicating. It's almost a happy accident when the local press — who also follow you on social media — sees your post and picks up the story. Bonus!
So when an officer saves a drowning boy, pulls two children from a hot car, stops a runaway crane truck, delivers a baby, or does some other heroic thing that's "just part of the job" departments should be shouting from the mountain tops, "See! This is what we're all about!"
I make no argument that the politicians, the press, and the people who are vehemently anti-police will suddenly have a change of opinion about you — a tidal wave of positive news coverage wouldn't do that — but those individuals are in the minority.
However, they are a very vocal minority.
The fact is, the overwhelming majority of American citizens respects and admires their police.
However, they are largely a silent majority.
They are your audience.
Give them a louder voice.
Give them your story.
They very much want to hear it — and they very much want to retell it.
